2. Definitions
- Service – the websites and application operating under the Tales4Kids and Bajki.ai brands, regardless of domain or language version.
- User – a natural person aged 18 or over who contracts with the Provider and uses the Service for themselves or as a parent or guardian.
- Wallet – an email-linked account accessed without a password through a secure link and cookie.
- Credit – an internal unit allowing one story generation to be started; it is not electronic money or a payment instrument.
- Story – text, illustrations and, on request, audio narration generated automatically from the User’s form.
- AI – third-party artificial-intelligence models used to create or moderate content.
3. Nature and scope of the Service
The Service lets Users complete a form, automatically generate a personalised story, optionally generate illustrations and narration, receive the story by email, manage Credits and submit feedback.
Content is generated by AI. The output is creative material that must be reviewed by an adult and is not educational, psychological, medical or legal advice.
The Provider may operate test features and change available models, voices, illustration counts or functions, provided this does not prejudice acquired rights or the contractual conformity of orders already placed.
4. Technical requirements
- a device with Internet access and a current browser supporting HTML5, JavaScript, HTTPS, cookies and local storage;
- a valid and active email address controlled by the User;
- for narration, a browser able to play MP3 audio with sound enabled;
- Internet access charges may apply under the User’s agreement with their network provider.
5. Contract and Wallet creation
The electronic-services and Wallet agreement is concluded when a new User submits the form after accepting the Terms and confirming that they have read the Privacy Policy. The email is then verified through a link.
Acceptance is recorded with the document versions, language, time and hashed technical evidence. Reading the Privacy Policy is an acknowledgement of information, not consent to marketing.
The Wallet has no conventional password. The User is responsible for securing their email account and device and must not share access links.
- Only a person aged 18 or over may create a Wallet.
- A child may not independently create a Wallet or submit the form.
- One Wallet may be maintained per email address; information must be accurate and current.
6. Children’s data and adult supervision
A User may provide a child’s first name or nickname and neutral plot details only if authorised to do so and must minimise the data provided.
- do not provide a surname, exact address, school or nursery, telephone number, login, photograph, document or other detail that easily identifies a child;
- do not provide health, disability, ethnicity, religion, sexuality or any other special-category data;
- before reading the Story to a child, an adult must review the text and images because AI may make mistakes or introduce unexpected elements.
7. Content rules
Users must not supply unlawful content, content infringing another person’s rights or material inconsistent with the purpose of the Service.
- sexual, obscene or vulgar content, violence, cruelty, self-harm, hatred, crime or drug content is prohibited, especially where children are involved;
- impersonation and infringements of privacy, personality rights, copyright, trade marks or other rights are prohibited;
- form fields are for direct answers; AI instructions, prompt overrides, film briefs, code and requests for other deliverables are prohibited;
- the Service must not be used unlawfully, for mass commercial generation, or to test or bypass safeguards.
8. Moderation and refusal
Form data is automatically checked for child safety and correct use. If prohibited content or general-purpose prompt misuse is detected, generation is refused and an explanatory notice is shown.
A refused result is not treated as a Story and receives no images, narration or rating. Because the model analysis has been performed and incurs cost, the Credit used for such a request is not refunded. A Credit is automatically refunded where generation fails solely because of a technical problem on the Service side.
Automated moderation produces no legal or similarly significant effect. A suspected error may be reported to info@tales4kids.ai.
9. Credits, rewards and payments
A started generation costs the number of Credits shown in the Service, currently one Credit. Complimentary welcome and reward amounts may change; the current amount is displayed before a reward is claimed.
Credits belong to a Wallet, do not expire unless an offer states otherwise, cannot be redeemed for cash, transferred or resold, and are not a deposit, currency or electronic money.
If paid packages are enabled, the price, currency, number of Credits and payment method will be shown before an order. Payment may be handled by a third-party provider and confirmation will be supplied on a durable medium.
Social-post rewards follow the rules displayed for the campaign. The same post URL may only be used once. Rewards may be refused in cases of abuse, automation or an invalid link.
10. Performance and availability
Generation starts after the conditions shown in the Service are met, including email verification or possession of a Credit. Progress timing is an estimate, not a guaranteed deadline.
A completed Story is available at a unique URL and may be emailed. Users should keep their own copy. Story text, form data, images and audio are generally removed from the Service after 30 days.
The Provider may temporarily interrupt the Service for maintenance, security or supplier outages and will seek to minimise planned disruption.
11. Nature of AI output
AI works probabilistically. We do not guarantee complete accuracy, factual correctness, uniqueness, consistent character appearance, or that a similar result will never be produced for another person.
Safety filters reduce but cannot eliminate risk. The adult User decides whether a Story is suitable for a particular child and must stop using it if inappropriate content is noticed.
Generated material must not be represented as solely human-created where that would mislead. When publishing, Users must preserve AI disclosure where required by law.
12. Rights in inputs and outputs
Users retain rights in content they lawfully submit and grant the Provider a non-exclusive, royalty-free licence to process it only as necessary to provide the Service, ensure safety and handle complaints.
To the extent the Provider holds transferable rights in an output, the User receives a non-exclusive, perpetual licence for private and family use, including saving, printing and non-commercial sharing.
Copyright protection of AI output depends on applicable law and human creative contribution. The Provider does not guarantee exclusive rights, registrability or commercial usability. Before publication or commercial use, the User must verify third-party rights.
13. Complaints and conformity
Complaints may be sent to info@tales4kids.ai or ul. Trybunalska 46, 60-325 Poznań, Polska. They should include the Wallet email, Story identifier, date, problem and requested remedy, but no unnecessary child data.
Consumer complaints are answered within 14 days unless mandatory law requires a shorter period. Failure to answer has the consequences provided by law.
Consumers retain all statutory remedies for non-conforming digital content and services, including bringing the service into conformity and, where applicable, price reduction or termination. These Terms do not restrict mandatory consumer rights.
14. Right of withdrawal
A consumer entering a distance contract generally has 14 days to withdraw without giving a reason by sending an unequivocal statement to info@tales4kids.ai or the Provider’s postal address.
If a consumer expressly requests that a paid service begin before the 14-day period expires, they may owe a proportionate amount for performance received. Once fully performed, the right may be lost if the consumer gave the required prior consent and acknowledgement.
For paid digital content not supplied on a tangible medium, withdrawal may be lost after supply begins only if all statutory conditions are met, including separate prior consent, acknowledgement and contract confirmation. Free services supplied in exchange for personal data also receive statutory consumer protection.
15. Termination and suspension
A User may stop using the Service at any time and request Wallet deletion at gdpr@tales4kids.ai. Deletion may exclude data that must be retained for law, accounting, complaints or legal claims.
Access may be suspended or terminated for a material or repeated breach, security threat, fraud or legal duty. Where circumstances allow, the User will be informed and may provide an explanation.
Closure of the Service will be announced with reasonable notice. Paid unused Credits will be made usable or appropriately settled as required by law.
16. Liability
The Provider is liable for failure to perform under mandatory law. Nothing excludes liability that cannot lawfully be excluded in relation to a consumer.
Subject to consumer rights, the Provider is not liable for unauthorised data supplied by a User, use despite visible errors, unverified commercial exploitation, or events beyond reasonable control.
For Users who are neither consumers nor entrepreneurs protected as consumers, liability for lost profits is excluded and aggregate contractual liability is limited to amounts paid in the preceding 12 months, except for intentional harm.
17. Changes to the Terms
Terms may change for valid reasons such as changes in law, Service functions, AI models, safety, payments or Provider details. Each version shows its effective date.
Material changes affecting an ongoing agreement will be notified through the Service or email with reasonable notice. Where renewed acceptance is required, continued use will require it; the User may terminate before the change takes effect.
18. Governing law and disputes
Polish law governs the contract. This choice does not deprive a consumer of mandatory protection under the law of their habitual residence.
Courts are determined by applicable law. Consumers may seek free help from consumer bodies and use an appropriate ADR entity; information is available at polubowne.uokik.gov.pl and in the EU list of ADR bodies.
The Provider does not generally commit to ADR unless required by law or agreed in a specific matter. The former EU ODR platform closed on 20 July 2025.
Language versions have the same informative purpose. If they conflict, Polish is the reference version to the extent permitted by mandatory consumer law.
